XXL - Judge Rules Error Was Made in Kodak Black’s Federal Firearms Case

Kodak Black could be making headway to be removed from the maximum security prison where he is currently serving time for his federal firearms case.

In court documents obtained by XXL, a judge signed a motion on Monday (June 8) agreeing that the Florida native's criminal history was exaggerated when he was sentenced back in 2019. The initial order, which was filed by Kodak's attorney, Bradford Cohen, last month, states that the rapper pleaded guilty "to a two-count indictment charging him with making a false statement in connection with the acquisition or attempted acquisition of a firearm."

During the rapper's 2019 sentencing, the court agreed that Kodak's history of drug use was "overly stated" and considered his criminal history a category two, despite the Presentence Investigation (PSI) report noting that Kodak's history is a category three.

The original motion, which was to correct a clerical error, also states that despite the court deducting a two-point enhancement, lowering Kodak's categorization, the Bureau of Prisons (BOP) disregarded the information disclosed in court and took action based on the PSI report. Thus, designating the 2016 XXL Freshman to serve his sentence at USP Big Sandy maximum security prison in Kentucky.

Cohen spoke with XXL and explained the new development in further detail. "The reason why we filed a Rule 46—Motion to Correct Clerical Error—is because in the PSI, which is a Presentence Investigation report, it listed his prior criminal history as a category level three, which obviously is more serious than a one, two, three is worse," the attorney says, noting that the categories can go up to level six. "But, they used a three in the PSI. The judge agreed with me at the time of sentencing that the level three overstates his criminal history because some of his priors were for like possession of under 20 grams of marijuana."

The categories in which offenders are placed in are based on a scoring system. In Kodak's case, his drug offenses put him in a category that allowed the BOP to put him in a maximum security facility.

Kodak Black's attorney, however, is advocating for the rapper to be put in a lower level prison, so that he will be able to attend a drug program, which is not offered at the maximum security prison. "I argued essentially that those prior criminal history is pushing him into a higher criminal category, which makes it worse for him, right?," Cohen continues. "But at the same token, the criminal cases that they're using to score him are possessions of marijuana that he's got a withhold and court costs on."

The attorney went on to say that as a result of the judge correcting the initial order and agreeing that the rapper's criminal history was overstated, Cohen can now use this documentation and take it to the prison where Kodak is being held to classify him into a lower designated prison. Cohen filed a motion last month to have his client removed from the facility.

Kodak was arrested for federal firearms charges last May ahead of his scheduled performance at Rolling Loud festival. Last Friday (June 5), his attorney confirmed to XXL that the multiple federal firearms charges against him, which carried a maximum sentence of 15 years in prison, had been dismissed.

Kodak Black's current release date is schedule for Oct. 7, 2022, according to the Federal Bureau of Prisons.

After recently having multiple weapons charges dismissed, Kodak Black could be released from prison sooner than expected.

On Saturday (June 6), Kodak's lawyer, Bradford Cohen, confirmed with XXL the incarcerated South Florida rapper could be released to a halfway house as early as 2021.

"It's possible, if the Bureau of Prisons re-designates him and realizes that they have a 22-year-old with 24 months left on his sentence in a Max Sec. Prison, 1100 miles from home," Cohen explained.

Kodak has to serve 500 hours of a drug treatment program before he becomes eligible to spend the last year of his sentence on supervised release. However, for this to happen, Kodak would have to be transferred to another facility, as the one he is currently housed at, Big Sandy in Kentucky, does not have the program.

Kodak recently made a step in the right direction for this to take place. On Friday (June 5), Cohen confirmed that his client had multiple weapons charges dropped by State Attorney Katherine Fernandez Rundle.

"We both felt we had positive things on each side of the case, but we didn't even discuss that," Cohen explained. "More just discussed in terms of fairness and what we thought was fair because he [Kodak] was charged federally with these same...well, it wasn't the same weapons because it wasn't a weapons charge in federal court, but it was the same nucleus of facts. Meaning, in federal court, he was charged with filling out a false form to obtain firearms and in the state case he was charged with the firearms. Because he wasn't a convicted felon, so they couldn't charge him federally for a convicted felon."

With charges being dropped, it could make way for Kodak to be released to a low security prison that does provide the drug treatment program he would have to complete to be eligible for early release to a halfway house.

Cohen has been fighting to get Kodak put in a new location. Last month, he filed a motion to have Kodak relocated to a downgraded facility.

Kodak has been locked up since he was arrested on federal firearms charges last May prior to the Rolling Loud Miami Festival. He later pleaded guilty to falsifying documents in order to obtain multiple firearms. Earlier this year, he pleaded guilty to firearms charges in New York. Kodak's current release date is Oct. 7, 2022, according to the Federal Bureau of Prisons.
